1. Welcome to Oklys
Our mission
Oklys is a medicinal product, whose Summary of Product Characteristics (SmPC) is managed by BestaMed.
BestaMed was founded with the mission to provide solutions and services to companies in the pharmaceutical sector. We are a dynamically growing supplier engaged in parallel trade of medicinal products, distribution of medical devices, dietary supplements, and more. We have achieved significant and sustainable growth thanks to being a reliable partner, focusing primarily on long-term collaborations with trusted partners in the industry.
Our mission is also based on the cause of achieving and maintaining transparency regarding the information we collect about you, how this information is used and shared, and your rights concerning your personal data.
2. Agreement
We hereby inform you that by accessing, registering and/or using the website and our services, you are entering into a legally binding agreement (even when you are using our services on behalf of a legal entity).
a) When you use the services of www.oklys.bg, you enter into a legally binding agreement with BestaMed;
b) This AGREEMENT includes the Terms and Conditions, Privacy Policy, Cookie Policy, and other terms you will see when you first use certain features on Oklys. New features may be added by Oklys from time to time. If you do not agree to this AGREEMENT, do not access, register, or use the website or our services.
c) This AGREEMENT applies to both registered users of our services, referred to as USERS, and unregistered users, referred to as VISITORS. The term USER applies to both categories — USERS and VISITORS.
d) To use the services of Oklys, you agree that you have reached the minimum age as defined by your local legislation. The services of the website must not be used by individuals under the age of 14.
3. Oklys takes care of your personal data
By registering on the Oklys website, users give their explicit consent for the collection of their personal information, as well as for its use by Oklys in accordance with these General Terms and Conditions and our separate Privacy Policy, which you should read carefully.

Oklys will take all lawful and reasonable measures to protect its users’ personal information.

4. Cookies
Cookies are small text files stored by your browser on the hard drive of your computer. The cookies used by BestaMed do not store any personal data.

5. Rules We Expect You to Follow as Users of Oklys:
5.1 Your User Status on the Website
These rights and obligations apply to all users of the Oklys website.
a) To become a user of the Oklys website, we will require you to complete a registration form, through which you will provide Oklys with your personal data and must agree to these Terms and Conditions, the Privacy Policy, and the Cookie Policy. Additional information may be requested if you register as a legal entity.
b) You must not create or use someone else’s account without permission.
c) In the event that BestaMed deactivates your account, you must not create another one without our permission.
d) You must not share your password or perform any actions that could compromise the security of your account.
e) You must not transfer your account (including the Page) to anyone else without obtaining our prior written consent.
f) In the event that you choose a name or similar identifier for your profile or page, BestaMed reserves the right to remove or confiscate it if deemed inappropriate (for example, when a trademark owner files a complaint regarding a username that is not closely related to the user’s real name).
g) You agree to use the Oklys website respectfully and not to post offensive or misleading content.
h) You are obligated to comply with all applicable professional codes of conduct when using the Oklys website and its services.
i) You must not send spam or other unsolicited messages to other individuals.
j) You must not engage in actions that are illegal, defamatory, abusive, indecent, discriminatory, or condemnable.
k) You must not post unsolicited or unauthorized advertising. You must not send junk mail, spam, chain letters/messages, pyramid schemes, or engage in other similar activities prohibited by BestaMed.
l) You agree that BestaMed reserves the right to transfer its rights and obligations regarding users, in whole or in part, to a third party.
You have the right to terminate this AGREEMENT at any time, in accordance with section 9 Termination of this Agreement.
You are responsible and accountable for all information, content, and actions related to your personal data and registration.
Registrations undergo a verification process by BestaMed. BestaMed cannot guarantee the identity of all users of our services. You are responsible for any damages caused if you use a registration and profile without the right to do so.
If you suspect that someone is attempting to compromise your personal data, you are obligated to notify BestaMed immediately.
5.2 Notifications, System Messages, and Advertising
Communication plays a key role in the maintenance and delivery of BestaMed’s services.
To control which messages you receive from Oklys via email, please review your profile settings.
5.3. Messages and Sharing
BestaMed’s services allow sending messages and sharing information through content and a messaging system. Information and content shared by you, if public, may be viewed by visitors to the website. Please note that some services are confidential by default and can only be seen by those for whom they are intended.
The Oklys website is not obligated to publish any information or content and may remove such content at its discretion, with or without notice.
5.4. Protection of the Oklys Website and User Information
The BestaMed team strives to keep the website safe but cannot guarantee it. We kindly ask you to assist in maintaining its security to the best of your ability.
a) You should strive to keep your account secure by: (1) choosing a strong and difficult password (minimum 6 characters, preferably a combination of letters and numbers); (2) keeping your password confidential; (3) reporting any suspicion that someone is attempting or has gained access to your account; (4) reporting any suspicion that someone is attempting or has compromised the security of the Oklys website.
b) You must not collect user content or information, nor otherwise access the Oklys website through automated means.
c) You must not engage in illegal marketing on the Oklys website.
d) You must not post information that contains software viruses or other harmful code.
e) You must not attempt to collect login information or access an account that belongs to another person.
f) You must not harass, insult, or harm other users.
g) You must not use the Oklys website for illegal, misleading, harmful, or discriminatory purposes.
h) You must not take actions that could disable, overload, or interfere with the normal functioning or interface of the Oklys website.
i) You must not engage in activities that simulate the appearance and functionalities of the website, nor in activities related to phishing and mirroring techniques that redirect users to fake or infected sites.
j) You must not: (1) claim or imply that you are representatives of the Oklys website; (2) rent, lease, lend, trade, or sell access to the website or related data; (3) derive monetary gain from BestaMed’s services or any other website functionality without the explicit consent of BestaMed.
k) You must not use deep links to our services without the explicit consent of BestaMed, except for the purpose of promoting the Oklys website.
l) You will not assist or encourage any violations of this AGREEMENT or our policies.
5.5 Protection of the Rights of Other Users
Users are obliged to respect and protect the rights of other users of the Oklys website:
a) You must not post content or take any other action on the Oklys website that infringes on the rights of others or otherwise violates the law.
b) You must not copy or use information, content, or data of other users available on the Oklys website unless you have explicit consent to do so.
c) You must not remove any notices regarding copyrights, trademarks, or other proprietary rights contained in the content on the Oklys website.
d) You must not disclose information that you are not authorized to disclose, nor violate intellectual property rights or other rights of Oklys or other individuals or legal entities without their explicit consent.
5.6. Intellectual Property Rights
BestaMed reserves all intellectual property rights over the website (including logos and other trademarks, service marks, designs or registered marks, technical or intellectual know-how):
a) You must not use BestaMed’s copyrights, trademarks, or other similar marks that may cause confusion, unless you have prior explicit written consent from BestaMed.
b) You must not copy or use information, content, or data from the Oklys website unless you have prior explicit written consent from BestaMed.
c) You must not copy, modify, or create derivative versions of the Oklys website, its services, or any related technology unless you have prior explicit written consent from BestaMed.
d) You must not apply engineering methods, decompile, disassemble, decrypt, or otherwise attempt to extract the source code of the website or any related technology, or parts thereof.
e) You must not remove any notices regarding copyrights, trademarks, or other proprietary rights contained in or on the Oklys website or its content.
6. User Rights
6.1. Sharing Content on the Oklys Website
As a user of the Oklys website, you own the content and information you post and control who can see your content through your profile settings. You grant Oklys a non-exclusive, worldwide, transferable, and sublicensable license to use, copy, modify, distribute, publish, and process the information and content you provide through the Oklys website, without requiring further consent, notice, and/or compensation to you or others. These rights are limited as follows:
a) You may terminate this license for specific content by requesting the deletion of that content from the Oklys website through a written request sent to office@bestamed.com.
b) BestaMed will not include your content in advertisements for third-party products and services (including sponsored content) without your explicit consent. Oklys reserves the right to display ads near your content and information without compensation to you or others.
c) BestaMed will seek your consent if it intends to grant others the right to publish your content outside the website. Other users may access and share your content and information on the Oklys website.
d) BestaMed may edit and modify the format of your content (for example, by translating, resizing, rearranging, changing the file type, or removing metadata), but will not alter the meaning of your information.
To keep the content relevant for users on the Oklys website and in accordance with applicable law, you agree to the following conditions:
a) BestaMed may access, store, and use any information you provide in accordance with these Terms and Conditions, the Privacy Policy, and the Cookie Policy.
b) BestaMed company, providing services and solutions in the healthcare sector, and its content should be related to the fields of health and healthcare.
c) The provided content or information must not violate the law or anyone’s rights (including intellectual property rights or any existing contract).
d) Applicable law may prohibit advertising prescription-only medicines to the general public. You agree that if you publish content or information regarding prescription medicines, it will be directed solely to medical professionals. If you are unsure whether the content or information relates to prescription medicines, you may contact a BestaMed administrator. You can also consult with them on what is considered advertising and how to properly target your content.
e) You declare that your information is accurate. BestaMed may be legally required to restrict and/or remove certain information or content from the website.
f) When you submit suggestions or provide feedback to Oklys regarding its Services, you agree that BestaMed may use and share them (but is not obligated to) for any purpose without compensation to you.
6.2. Other content
By using the Oklys website, you may come across content or information that may be inaccurate, incomplete, delayed, misleading, illegal, offensive, or harmful. In general, BestaMed does not review content provided by its users. You agree that Oklys is not responsible for third-party content and information (including users’) or for any damages and lost profits resulting from their use or reliance on them.
6.3. Limitations
BestaMed reserves the right to modify, temporarily suspend, or terminate any service. Oklys is not obligated to store, maintain, or provide a copy of any content or information posted by users, except as expressly required by law.
BestaMed reserves the right to restrict the use of the website, including the number of user contacts and the ability to connect with other users.
BestaMed reserves the right to restrict, temporarily suspend, or terminate a user account in case of suspected violation of this AGREEMENT.
The Oklys website contains information related to healthcare but does not provide medical advice. For any health issues, you should seek advice from a certified medical professional in accordance with applicable law.
7. Disclaimer and Limitation of Liability
We strive to maintain the proper functioning, virus-free status, and security of the BestaMed website, but you use it at your own risk. We provide the BestaMed website “as is,” without any express or implied warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the BestaMed website will always be safe, secure, error-free, or that it will function uninterrupted, without delays or issues.
BestaMed is not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and representatives from any claims and damages, known or unknown, arising from or in any way related to any claims you may have against such third parties.
To the extent permitted by law (and unless BestaMed has entered into a separate WRITTEN AGREEMENT that takes precedence over this AGREEMENT), BestaMed (and those with whom BestaMed collaborates to provide the services) shall not be liable to you or others for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, opportunities, reputation, profits, or revenues related to the services (such as offensive or defamatory statements, downtime or loss, use, or changes to your information and content).
Applicable law may not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.
8. Changes
We may periodically amend/update these Terms and Conditions, the Privacy Policy, and the Cookie Policy. If we make any changes, we will notify you through our services and/or by other means to give you the opportunity to review the changes before they take effect. If you continue to use our services after the notice period has expired and the changes have taken effect, this will mean that you have agreed to the amended/updated Terms and Conditions, Privacy Policy, and Cookie Policy.
If you do not agree to these changes, you should stop using the website and terminate your membership in accordance with Section 9 Termination.
We may periodically amend/update these Terms and Conditions, the Privacy Policy, and the Cookie Policy. If we make any changes, we will notify you through our services and/or by other means to give you the opportunity to review the changes before they take effect. If you continue to use our services after the notice period has expired and the changes have taken effect, this will mean that you have agreed to the amended/updated Terms and Conditions, Privacy Policy, and Cookie Policy.
If you do not agree to these changes, you should stop using the website and terminate your membership in accordance with Section 9 Termination.
9. Termination
9.1. Termination by the User
You may terminate this AGREEMENT at any time by simply stopping the use of our services and/or closing your account by sending an email to office@bestamed.com. Upon termination, you lose the right to access or use the website as a user.
9.2. Termination by Oklys
BestaMed may terminate this AGREEMENT by sending you an email in the following cases:
a) In the event that BestaMed ceases to operate the website.
b) In the event that BestaMed believes you provide false information, are below the minimum required age to use the website, or register to access areas of the site for which you do not have the necessary certification.
c) In the event that BestaMed believes you are violating your obligations as a user.
d) In the event that BestaMed believes you are violating the rights of others or jeopardizing the security of the Oklys website or other individuals.
e) In the event that you violate these terms and conditions in any other way.
9.3. Even after termination of the AGREEMENT, the following shall remain in effect:
a) BestaMed’s rights to use and disclose user feedback;
b) The rights of other users to reshare content and information posted by users who have terminated their participation on the website, limited to the scope of what was already shared and copied before termination;
c) Sections 6, 9, and 10 of this AGREEMENT;
d) Any amounts owed by either party before termination shall remain payable after termination.
10. Dispute Resolution
a) All clauses shall be governed by Bulgarian law, without regard to its conflict of law provisions.
b) Any dispute related to these Terms and Conditions shall be resolved by mutual agreement and settled in accordance with the laws of the Republic of Bulgaria.
c) In the event that a claim is made against BestaMed related to actions of users, content, or information on the Oklys website uploaded by users, the user shall indemnify BestaMed for all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such a claim.
